1. About these Terms
These Terms of Use ("Terms") govern your access to and use of the website at getwildfire.gg and its subdomains, excluding spark.getwildfire.gg (the "Site"). The Site is operated by Certainly Stuff Ltd, trading as Wildfire ("Wildfire", "we", "us", or "our").
By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, please do not use the Site.
These Terms apply to your use of the Site only. They do not govern:
- the supply of marketing or campaign services by Wildfire, which is the subject of separate written agreements (master services agreements, statements of work, or insertion orders) entered into with clients;
- the Spark platform, which is governed by the Spark terms of service made available within the Spark application;
- third-party platforms on which Wildfire campaigns may run, each of which has its own terms.
2. Eligibility
The Site is intended for use by business contacts aged 18 or over acting in a professional capacity. By using the Site you confirm that you meet this eligibility requirement.
The Site is not directed at children. If you are under 18, please do not use the Site or submit personal information through it.
3. Permitted use
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for lawful business purposes, including:
- viewing and reading content published on the Site;
- downloading and printing materials we make available for download (for example, case studies, brochures, or media kits) for your own internal business use, retaining all copyright and other proprietary notices;
- sharing public links to pages on the Site by ordinary means;
- contacting us using the channels provided.
Any other use of the Site or its content requires our prior written consent.
4. Prohibited use
You agree not to use the Site, or permit anyone acting on your behalf to use the Site:
- in any way that breaches applicable laws or regulations, including data protection, anti-spam, intellectual property, sanctions, and export control laws;
- to scrape, harvest, mine, or otherwise extract content or data from the Site by automated means, except for legitimate search-engine indexing by reputable public search engines that respect our robots.txt file;
- to introduce or attempt to introduce viruses, malware, trojans, worms, logic bombs, or other technologically harmful material;
- to attempt to gain unauthorised access to the Site, to any server, computer, or database connected to the Site, or to any account, system, or network associated with Wildfire;
- to reverse-engineer, decompile, or attempt to derive the source code of any part of the Site, except to the extent that applicable law expressly permits such activity;
- to probe, scan, or test the vulnerability of the Site or any associated systems, or to breach or circumvent any security, authentication, or access control measures, without our prior written consent;
- to impersonate Wildfire, any Wildfire employee, or any other person, or to misrepresent your affiliation with Wildfire;
- to send unsolicited communications, advertising, or promotional material through or in connection with the Site;
- to harass, abuse, defame, or threaten any person, or to publish material that is unlawful, obscene, or infringing;
- to use the Site to develop, train, test, or improve any artificial-intelligence or machine-learning model, dataset, or product, or to enable any third party to do so, without our prior express written consent;
- to use the Site to build or assist in building any product or service competitive with Wildfire's services.
We may suspend or terminate your access to the Site if we believe in good faith that you have breached these Terms or that your use of the Site poses a risk to us, to other users, or to the integrity of the Site.
5. Automated access and AI training
The content made available on the Site is published for human readers. Use of the Site (including any content, data, or metadata) for the purposes of developing, training, fine-tuning, testing, validating, evaluating, or improving any artificial-intelligence model, large language model, generative model, or related dataset or product is expressly prohibited without our prior written consent. This applies whether the use is by you directly or by any third party acting on your behalf or to whom you provide access.
This restriction is in addition to, and does not derogate from, the intellectual property rights set out in section 6 below.
6. Intellectual property
All content on the Site, including text, graphics, logos, images, video, audio, code, design, page layout, and the selection and arrangement of content, is owned by or licensed to Certainly Stuff Ltd and is protected by copyright, database rights, and other intellectual property laws.
The names "Wildfire" and "Spark", the Wildfire logo, and other Wildfire product and brand names are trademarks of Certainly Stuff Ltd (whether registered or unregistered). No right or licence to use any Wildfire trademark is granted to you by these Terms.
Other product names, logos, brands, and trademarks referenced on the Site are the property of their respective owners. References on the Site to third-party platforms (including Discord, Reddit, and others) are descriptive only and do not imply any sponsorship, endorsement, affiliation, or partnership between Wildfire and any such platform unless expressly stated.
You may quote, reference, or link to content on the Site for legitimate commentary, journalism, research, criticism, or review, provided that:
- the use is fair and accurate;
- Wildfire is properly credited as the source;
- any quoted material is reproduced without alteration of its meaning;
- the use does not imply Wildfire's endorsement of the user or the user's products or services.
All other use of Site content, including reproduction, modification, redistribution, public display, or commercial exploitation, requires our prior written consent.
7. Submissions and communications
If you contact us through the Site, by email, by mobile message, or otherwise (for example, via contact forms, recruitment enquiries, partner registration forms, or general correspondence), you grant us a worldwide, non-exclusive, royalty-free, perpetual licence to use, reproduce, store, and act upon your communication for the purposes of responding to you, conducting our business, and improving our services. We will handle any personal data in your communication in accordance with our Privacy Policy.
Please do not send us confidential, proprietary, or trade-secret information through unsolicited contact unless we have agreed in writing to receive it on confidential terms.

11. Limitation of liability
Nothing in these Terms excludes or limits our liability for:
- death or personal injury caused by our negligence;

Subject to the paragraph above, and to the maximum extent permitted by law:
- we exclude all conditions, warranties, and other terms that might otherwise be implied by statute, common law, or the law of equity;
- we will not be liable to you for any loss of profit, loss of business, loss of revenue, loss of anticipated savings, loss of goodwill, loss or corruption of data, or any indirect, special, consequential, or punitive loss, whether arising in contract, tort (including negligence), breach of statutory duty, or otherwise;
- our total aggregate liability to you arising out of or in connection with your use of the Site, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, is limited to £100.
The above limitations apply to liability arising in connection with the Site only. Liability under separate written agreements between Wildfire and its clients (including master services agreements, statements of work, and insertion orders) is governed by the terms of those agreements.
12. Indemnity
You agree to indemnify and hold harmless Wildfire and its officers, employees, and agents from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- your breach of these Terms;
- your misuse of the Site;
- your violation of any applicable law or regulation; or
- your infringement of any third-party right in connection with your use of the Site.
13. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including any breach of these Terms. Sections 4 (Prohibited use), 5 (Automated access and AI training), 6 (Intellectual property), 10 (Disclaimer of warranties), 11 (Limitation of liability), 12 (Indemnity), and 14 (Governing law and jurisdiction) survive termination.
14. Governing law and jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims), are governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter or formation. This does not affect any non-waivable rights you may have as a consumer under the laws of your country of residence.
15. Changes to these Terms
We may update these Terms from time to time. The current version is identified by the "Last Updated" date at the top of this page. Material changes will be notified by appropriate means, which may include a notice on the Site. Your continued use of the Site after a change has taken effect constitutes acceptance of the revised Terms.
16. General
- Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Wildfire in relation to your use of the Site and supersede any prior agreements or understandings.
- Severability. If any provision of these Terms is held to be invalid or unenforceable, that provision is severed and the remaining provisions remain in full force and effect.
- No waiver. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
- Assignment. You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms at any time.
- No partnership. Nothing in these Terms creates any partnership, agency, joint venture, or employment relationship between you and Wildfire.
- Third-party rights. A person who is not a party to these Terms has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms.
